§ 11A-2. Permit—Required; application, transfer and false statements.

  • (a)

    No person shall operate, cause to be operated, or permit the operation of an alarm system or systems at an alarm site unless a valid permit has been issued by the police department for such system. This requirement shall not be applicable to an alarm protective service unless the alarm protective service is the owner, agent, or person in control of the property which the alarm system is designed to protect. An alarm system user shall be in violation of this chapter if he permits the operation of such system without a proper permit.

    (b)

    An alarm system user or his agent shall obtain a permit for each alarm site.

    (c)

    Any person with an alarm system on the effective date of this chapter must apply for a permit within thirty (30) days after the effective date.

    (d)

    Application for a permit for the operation of an alarm system or systems at an alarm site shall be made with the police department by the owner, agent, or person having control over the property on which the alarm system is to be installed and operated. Application shall be made in writing on a form designated by the city. On such application form, the applicant shall set forth:

    (1)

    Name, address, and telephone number of the owner, agent, or person in control of the property to be protected.

    (2)

    Street address of the property on which alarm system is to be installed and operated.

    (3)

    Brief description of the type of property to be protected.

    (4)

    Any business name or title used for the premises on which the alarm system is to be installed and operated.

    (5)

    Name, address, and telephone number of the alarm protective service or person who will install and service the alarm system.

    (6)

    Name and telephone numbers of one (1) or more persons who are able to and have agreed to receive notification at any time for the city police department in order to de-activate the alarm system if it becomes necessary.

    (7)

    Any other pertinent information required by the city police department which is necessary for the enforcement of the chapter.

    (e)

    A nonrefundable fee of twenty-five dollars ($25.00) per year is required for each permit or renewal of a permit. Persons sixty-five (65) years of age or older obtaining a permit for an alarm system operated at the person's primary residence shall pay a reduced fee of five dollars ($5.00) per year for that permit or renewal of that permit. (Proof of age may be required.)

    (1)

    Permit fee of twenty-five dollars ($25.00) per fiscal year regardless of when issued.

    EXAMPLE: If permit is purchased in January—$25.00; or if purchased in July—$25.00.

    (2)

    Permit good only August 1 through July 31 of each fiscal year.

    (f)

    The director of planning and community development for the city shall issue a permit to the person in control of the property to be protected upon submission in person or by mail of a completed application and payment of the appropriate fee, unless any statement made on the application is incomplete or false.

    (g)

    The police department shall treat all information on the application as confidential.

    (h)

    Each permit issued to an alarm system user shall be valid until such time as one of the following occurs:

    (1)

    Control of the protected property is transferred from the permit holder.

    (2)

    Permit holder voluntarily discontinues services provided by a particular alarm service, and/or disconnects the alarm system.

    (3)

    Revocation of the permit by the police department according to violation. (See permit suspension.)

    (i)

    A permit holder must inform the police department of any change that alters information listed on the permit application. No fee will be assessed for such changes unless subsection (d) hereof is invalid at time of alarm activation.

    (j)

    Any false statement or misrepresentation of a material fact made by an applicant for the purpose of obtaining an alarm permit or renewal, or while making a change on said permit, shall be sufficient cause for refusal to grant, or suspension of, a permit.
