§ 11A-1. Definitions.

  • In the construction of this chapter, the following definitions shall apply:

    (1)

    Alarm site means:

    a.

    Premises or location served by an alarm system; and

    b.

    Single premises or location (one (1) street address) served by an alarm system or systems that are under the control of one (1) owner.

    (2)

    Alarm system means a device or system that emits, transmits, or relays a signal intended to summon emergency services of the city, including, but not limited to, local alarms. Alarm system does not include:

    a.

    An alarm installed on a vehicle unless installed at a permanent site.

    b.

    An alarm installed on a vehicle unless for a habitation at a permanent site.

    c.

    An alarm designed to alert only the inhabitants of a premises.

    d.

    An alarm installed upon premises occupied by the city.

    (3)

    Automatic dialing device means:

    a.

    Any device connected to an alarm system which automatically sends a pre-recorded message or coded signal indicating the activation of an alarm system to a predetermined location.

    b.

    Systems which automatically send over regular telephone lines by direct connection or otherwise, a pre-recorded voice message or coded signal indicating the existence of the emergency situation that the alarm system is designed to detect.

    c.

    An alarm notification sent over telephone lines by direct connection or otherwise, a pre-recorded voice message, synthesized voice message, or coded signal indicating the existence of the emergency situation that the alarm system is designed to detect.

    (4)

    Alarm protective service means any service in which persons providing such service install, service, repair, maintain, sell, replace, or respond to an alarm system or cause any of these activities to take place. This term shall not include any persons engaged solely in the sale of alarm systems designed to cause an audible and/or visual signal to be emitted only in or on premises in which system is installed.

    (5)

    Emergency medical assistance means notification to summon emergency medical assistance from the city.

    (6)

    Burglar alarm means:

    a.

    Notification intended to summon the police, which is initiated or triggered by an alarm system designed to respond to simulated characteristics of unauthorized intrusion on or into an alarm site.

    b.

    An alarm system signaling an entry or attempted entry into an area protected by the alarm system.

    (7)

    Director means:

    a.

    Chief of police or his authorized representative.

    b.

    Chief of the department of police service of the City of Marshall, or his authorized representative.

    (8)

    Alarm freeze means notification by the City of Marshall police chief to the city manager/city commissioners advising that no additional alarm system or systems will be installed in the police department complex until the chief deems it advisable to cancel the alarm freeze.

    (9)

    False burglar alarm notification means:

    a.

    Notification to the police, when the responding police officer finds no evidence of unauthorized intrusion or attempted unauthorized intrusion.

    b.

    Activation of an alarm system through mechanical or electronic failure, malfunction, improper installation, negligence of the owner, agent, or person in control of the property, or any such emergency for which the alarm system was designed to give notice and for which the responding police officer finds no evidence of any criminal activity.

    c.

    This term does not include those caused by weather conditions or other conditions which the chief determines could not have reasonably been prevented by the permit holder.

    (10)

    False emergency medical assistance means notification to police and/or fire/EMS, when the responding personnel find no evidence of need for emergency medical assistance.

    (11)

    False fire alarm means notification to police/fire, when responding fire department personnel find no evidence of a fire having occurred or of a need for fire department services.

    (12)

    False robbery alarm means notification to the police, when the responding police officer finds no evidence of a robbery.

    (13)

    Fire alarm means notification to police/fire intended to summon fire fighting forces, which is initiated or triggered manually by an alarm system designed to react to any of the visual or physical characteristics of fire.

    (14)

    Local alarm means an alarm system that emits a signal at an alarm site that is audible or visible from the exterior of a structure and has as its purpose the summoning of aid from a city department.

    (15)

    Person means an individual, corporation, partnership, association, organization or two (2) or more persons having a joint or common economic interest to whom an alarm system permit is issued.

    (16)

    Robbery alarm notification means notification intended to summon the police when a robbery and/or attempted robbery occurs by means of an alarm system designed to be purposely activated by an individual.

    (17)

    Financial institution means an institution required to have an alarm system by the provisions of the Bank Protection Act of 1968 (12 USC 1882, as amended).

    (18)

    Permit means certificate of authorization issued by the police department to the owner, agent, or person in control of the property which authorizes the operation of an alarm system or systems at an alarm site.

    (19)

    Shutoff means an automatic device associated with an alarm system which automatically causes the alarm to shut off and discontinue the emission of an audible signal after a period of time not to exceed thirty (30) minutes of continuous operation.
