§ 4-21. Dangerous dogs.

  • (a)

    Dangerous dog. Shall refer to a dog determined dangerous in compliance with the Texas Health and Safety Code, Section 822, as amended, or that meets the following criteria: A dog that makes an unprovoked attack on a domestic animal that causes the death or serious bodily injury to that domestic animal and the attack occurs in a place other than the dog owner's property.

    (b)

    This section sets forth dangerous dog requirements and restrictions that are in addition to state law, as authorized in Section 822.047 of the Texas Health and Safety Code. This section must be construed and implemented in conjunction with Chapter 822 of the Texas Health and Safety Code.

    (c)

    No person shall own, keep or harbor a dangerous dog within the city limits, except as provided under state law and this section.

    (d)

    No person who owns, keeps or harbors a dog shall allow the dog to engage in fierce or dangerous conduct.

Ord. No. O-04-31, § 2, adopted Nov. 15, 2004, repealed the former § 4-21, and enacted a new section. The former § 4-21 pertained to special confinement requirements and derived from Ord. No. O-85-32, adopted June 27, 1985.
