§ 30-89. Correction notices.

  • (a)

    Any officer of the city with power to enforce this article may, when in their judgment and for health and safety reasons, it becomes necessary to protect the passengers, the general public or the horse:

    (1)

    Remove a horse form a public street until such time as the horse is re-examined by a veterinarian of this state and the permit holder obtains a certificate from that veterinarian stating the horse has been personally examined by him and such horse is fit to return to work in the horse-drawn carriage business.

    (2)

    Remove a carriage from the street when it is not in compliance with the provisions of this article. The carriage shall not be allowed to operate on public streets until a reinspection is performed and the chief of police or his designee certifies it to be in compliance with the provisions of this article.

    (b)

    When a horse or carriage is removed from service, an officer with the power to enforce this article shall issue a correction notice to the driver or permit holder. Such notice shall state the specific reason for action taken and that the carriage or horse shall not be allowed to operate until a re-inspection is conducted and is certified to be in compliance.
