§ 21-11.1. Hunting prohibited; using steel traps prohibited; exceptions.

  • (a)

    Generally. It shall be unlawful for any person within the corporate limits either on public or private property to do any of the following acts:

    (1)

    To knowingly shoot, kill or retrieve any wild game. (Hunt and Wild game as defined by the Texas Parks and Wildlife Code, as amended.)

    (2)

    To set a trap or to trap any animal by the use of a steel-jawed spring trap or any other type of trap that would be injurious to the animal or person; provided, however, that this provision shall not apply to the trapping of rodents by use of conventional means.

    (b)

    Exceptions. The following exceptions apply to this section:

    (1)

    Bow hunting within the corporate limits of the city shall be permitted under the following conditions:

    (i)

    The person is a licensed hunter in compliance with the Texas Parks and Wildlife Code, targeting legal game during the legal season;

    (ii)

    The person is hunting on his or her private property or with written consent of the property owner; and,

    (iii)

    The person may not retrieve any game, arrows, or other projectiles from another person's property without the written consent of the owner.

    (c)

    The provisions of this section shall not apply to an animal control officer, or any other public safety officer, acting in their official capacity.
