§ 15A-17. Safe, sanitary and maintenance required.

  • No person shall occupy as owner-occupant or let to another for occupancy any dwelling or dwelling unit, for the purpose of living therein which does not comply with the requirements of this section:

    (1)

    Basic structure. Every foundation, floor, wall, ceiling, and roof shall be reasonably weathertight, and watertight, shall be capable of affording privacy; and shall be kept in good repair.

    (2)

    Windows, doors, hatchways. Every window, exterior door, and basement hatchway shall be reasonably weathertight and watertight, and shall be kept in sound working condition and good repair.

    (3)

    Exterior surfaces. Exterior of all buildings shall be free from holes, breaks, and loose or rotting materials; and maintained weatherproof and properly surface coated where required to prevent deterioration. All exterior wall materials shall be of masonry, metal, wood, or other acceptable material as permitted by the zoning ordinance.

    (4)

    Premises identification. Buildings shall have approved address numbers placed in a position to be plainly legible and visible from the street or road fronting the property. These numbers shall contract with their background. Address number shall be Arabic numerals or alphabet letters and not less than four (4) inches in height with a minimum stroke width of one-half (0.5) inch.

    (5)

    Stairs, porches. Every inside and outside stair, every porch, and every appurtenance thereto shall be so constructed as to be safe to use and capable of supporting the load that normal use may cause to be placed thereon; and shall be kept in sound condition and good repair.

    (6)

    Fences. All fences shall be maintained structurally sound and not be out of vertical alignment more than twenty (20) percent. All damaged, rotting, removed, or missing portions shall be replaced with comparable materials to the remaining portion of the fence and shall be kept free from deterioration. Any fence that has deteriorated to a condition that is likely to fall shall be repaired, replaced or removed. Fences shall not be externally braced in lieu of replacing or repairing posts, columns, or other structural members. All damaged or missing parts of chain link or metal fences shall be replaced or repaired.

    (7)

    Private parking lots, drives, and streets. Private parking lots, drives, streets, and improved surfaces shall be maintained in good, safe condition and be free of litter, holes, excavation, protrusions, cracks, vegetation or other failures that may affect the use, safety, appearance, or drainage of the property or the adjoining property. In all non-residential parking lots, fire lanes, and required paved areas with legible parking and fire lane markings shall be maintained in accordance with city ordinances.

    (8)

    Glare and direct illumination. Exterior lights placed or erected on private property shall be shielded, placed or erected so as not to create a traffic hazard or a public nuisance. They shall be located so as to not produce direct illumination across the bounding property line.

    (9)

    Plumbing facilities.

    a.

    Every dwelling unit shall be provided with a water closet, lavatory and a bathtub or shower; such facilities shall be in a separate enclosed room located within and accessible from within the dwelling unit.

    b.

    All plumbing fixtures shall be connected to the sanitary sewer system of the city, or to an approved private sewage disposal system.

    c.

    All plumbing fixtures shall be connected to an approved system of water supply and provided with hot and cold running water, except the water closet which shall be provided with cold water only.

    d.

    All plumbing fixtures shall be of an approved glazed earthenware type, or of a similar nonabsorbent material.

    e.

    Every plumbing fixture and water and waste pipe shall be properly installed and maintained in good sanitary working condition, free from defects, leaks, and obstructions.

    (10)

    Bathroom floors. Every water closet compartment floor surface and bathroom floor surface shall be constructed and maintained so as to permit such floor to be easily kept in a clean and sanitary condition.

    (11)

    Construction, installation of required facilities. Every facility, piece of equipment, or utility which is required under this chapter shall be so constructed or installed that it will function safely and effectively, and shall be maintained in satisfactory working condition.

    (12)

    Discontinuance of required facilities prohibited. No owner, operator, or occupant shall cause any service, facility, equipment, or utility which is required under this chapter to be removed from or shut off from or discontinued for any occupied dwelling let or occupied by him, except for such temporary interruption as may be necessary while actual repairs or alterations are in process, or during temporary emergencies.

    (13)

    Occupying, letting unsanitary dwelling prohibited. No owner shall occupy or let to any other occupant any vacant dwelling unit unless it is clean, sanitary and fit for human occupancy.

    (14)

    Rubbish facilities. Every dwelling unit shall be supplied with adequate rubbish storage facilities.

    (15)

    Garbage facilities. Every dwelling unit shall have adequate garbage disposal facilities or garbage storage containers.

    (16)

    Kitchen facilities. Every dwelling unit shall be provided with a kitchen and each kitchen shall contain a kitchen sink.
