§ 13A-58. Toilet facilities.

  • (a)

    Generally: Each food establishment shall be provided with adequate, conveniently located toilet facilities for its employees, separate and distinct from toilet facilities for patrons or customers. Toilet fixtures shall be of sanitary design and readily cleanable. Toilet facilities, including rooms and fixtures, shall be kept in a clean sanitary condition and in good repair. The doors of all toilet rooms shall be self-closing. Toilet tissue shall be provided. Easily cleanable receptacles and/or disposable plastic bags shall be provided for waste materials, and such receptacles in toilet rooms for women shall be covered. Where the use of non-water-carried sewage disposal facilities have been approved by the health authority, such facilities shall be separate from the establishment. Separate toilet facilities shall be provided for men and women patrons in restaurants, clubs and lounges.

    (b)

    Reason: Adequate, sanitary toilet facilities are required to assure proper disposal of human excrements which carry pathogenic organisms. When toilet facilities are of a sanitary design and are kept clean and in good repair, and are properly used, the opportunities for the spread of contamination by flies, insects, clothing, hands or other means are minimized. Receptacles are necessary for waste materials.

    Where management provides employees with adequate toilet facilities which are kept clean and properly maintained, employees are more likely to have a proper attitude toward sanitary practices and conditions in the food establishment.

    Non-water-carried sewage disposal facilities require periodic cleaning, which is an insanitary operation. Furthermore, such facilities create insect, rodent and odor control problems. Thus, non-water-carried sewage disposal facilities should be kept separate from the food establishment.

    (c)

    Compliance: This section shall be deemed to have been satisfied when the following requirements are met:

    (1)

    General:

    a.

    Toilet facilities shall be adequate and conveniently located and shall be accessible to the employees and men and women patrons at all times.

    b.

    Toilet facilities shall be installed in accordance with applicable state and local laws, ordinances and regulations.

    c.

    Water closets and urinals shall be of a sanitary design.

    d.

    Toilet room shall be completely enclosed and well ventilated, and shall have tight-fitting, self-closing doors. Such doors shall not be left open except during cleaning or maintenance. If vestibules are provided, they shall be kept in a clean condition and in good repair.

    (2)

    Maintenance:

    a.

    Toilet facilities, including the toilet room and fixtures, shall be kept clean, sanitary, in good repair and free of objectionable odors.

    b.

    A supply of toilet tissue shall be provided at each toilet at all times. Easily cleanable receptacles and/or disposable plastic bags shall be provided for waste materials, and such receptacles in toilet rooms for women shall be covered. Such receptacles shall be emptied at least once a day and more frequently when necessary to prevent excessive accumulation of waste material.
